PassTheNoteKids Terms of Use

Applies to the passthenotekids.com website and the PassTheNoteKids app.

These Terms of Use are an agreement between you and PassTheNoteKids LLC, a Florida limited liability company ("we", "us", "our"). Please read them with our Privacy Policy at passthenotekids.com/privacy, which explains how we handle your family's information.

1. What these Terms cover

These Terms cover everything we call PassTheNoteKids:

PassTheNoteKids launches on November 1, 2026 on the web, with our iPhone app to follow in Apple's App Store, in the United States only. These Terms apply to everyone who uses PassTheNoteKids.

If you only visit our website, the parts of these Terms about using the website apply to you (sections 1, 13, 17, 18, 19 and 20).

2. Agreeing to these Terms

When you create an account, we ask you to tick a box that says "I agree to the Terms of Use and have read the Privacy Policy." You cannot create an account without agreeing.

When a co-parent joins your household, they tick a box that says: "I am 18 or older. I agree to the Terms of Use and have read the Privacy Policy, and I consent to PassTheNoteKids collecting, using and disclosing my household's children's information as the Privacy Policy describes, including the automated AI safety check." A co-parent cannot join without agreeing. If you do not agree, do not create an account or use PassTheNoteKids.

3. Who can use PassTheNoteKids

The parent is the account holder. A parent or legal guardian who is at least 18 opens the account and agrees to these Terms. Each parent or guardian with an account, including a co-parent, enters into these Terms with us. Your children use PassTheNoteKids under your account, with your permission and under your supervision.

United States only. PassTheNoteKids is offered only in the United States. You must live in the United States to create an account.

Children 17 and under only. PassTheNoteKids is only for children who are 17 or younger. We do not ask for or check a child's birthday or exact age. We rely on you. It is your responsibility to:

A child who has turned 18 may not keep using PassTheNoteKids under your account.

You are responsible for your children's use. You are responsible for how each child on your account uses PassTheNoteKids, and for making sure they follow these Terms.

Co-parents. You can invite another parent or legal guardian into your household. A co-parent agrees to these Terms and gives their own parental consent (section 5). Section 10 explains what a co-parent can see and do.

4. Your account and devices

5. Parental consent

Before you can add a child, we ask you to confirm that you are at least 18 and the child's parent or legal guardian, and to complete a $0.50 charge on a payment card. We refund that charge immediately. It is a check that an adult is giving consent, not a fee, and it is separate from any paid plan. Starting the Family plan's free trial then asks for a card again at checkout (section 6). A co-parent completes the same steps before they can see or manage your children. The iOS app does not take a card; it sends you to the parent portal in a browser to do this. Our Privacy Policy, section 8, explains what we record.

6. Paid plans, billing and cancellation

PassTheNoteKids has no ads and no free plan. Families use it through the Family plan, a paid subscription that starts with a free trial. If a trial or plan ends without payment, you can still sign in and view your family's information, but your children cannot send notes and cannot use groups or games until a paid plan starts (see "When your plan ends" below).

Free trial. Every new family that subscribes to the Family plan gets one 14-day free trial, once per family however it subscribes. To start it, you add a credit or debit card at checkout; this is separate from the refunded $0.50 consent check in section 5. We will email you a reminder 3 days before your free trial ends. If you do not cancel before the trial ends, your subscription starts and your card is charged automatically for the plan you chose, and your plan then renews automatically as described below. You can cancel at any time during your trial and you will not be charged. If you cancel during your trial, or your trial ends without a paid plan, your children can no longer send notes or use groups or games, as described below.

Plans and prices. Our Family plan is priced per child, and one Family subscription covers up to 6 children. Every child profile counts. The price depends on how many children your plan covers. Monthly and yearly billing are both available. The following regular prices are in US dollars. Yearly plans are billed for the full year upfront. Your total, including any applicable tax, is shown before you pay.

Adding or removing a child. If you add a child on a web plan, your price goes up right away and you are charged a prorated amount for the rest of the current billing period. If you remove a child from your plan, your lower price starts at your next renewal; we do not refund partial periods, and that child keeps access until then. Removing a child from your plan is different from deleting the child's profile, which stops that child's access immediately and starts deletion (Privacy Policy, section 9). If we later offer plans in an app store, that store's rules decide when a change takes effect. If your account has more children than your plan covers, those children keep working for up to 15 days while we remind you to update your plan; after that, the children above your plan's number are paused, newest first, until your plan matches. Nothing is deleted.

Founding families. Families who sign up for the Family plan on our website between November 1, 2026 and 11:59 p.m. Eastern Time on December 1, 2026, finish the 14-day free trial, and make their first successful monthly payment may qualify for one of 50 founding places. The first 50 eligible families whose first successful monthly subscription payment claims an available founding place automatically receive discounted monthly pricing for up to 3 children during their first 12 paid monthly billing periods (year one), starting with that first payment. No coupon code or manual enrollment is required. That is $8.33 a month for 1 child, $14.17 a month for 2 children, or $17.66 a month for 3 children, instead of the regular monthly price of $11.99, $18.99 or $23.99. After those 12 months, the family pays the regular monthly price, unless the family switches to the yearly plan ($99.99 a year for the first child), like any other family. Founding families on the yearly plan pay the regular yearly prices, with no extra discount. If a founding family switches to the yearly plan during the first 12 months, the founding price ends permanently and the family pays the regular yearly price. A fourth, fifth or sixth child on the plan is charged the regular price. Your first payment is initially charged at the regular monthly price. If that payment claims a founding place, we automatically refund the difference between that charge and the founding price; the time it takes the refund to appear depends on your payment provider. Later qualifying monthly payments use the founding price. A founding place is counted only when a family's first successful payment after the free trial goes through. Starting a free trial does not reserve a founding place. If all 50 places are taken while a family is still in its trial, that family pays the regular price. Places are never reissued. The founding discount is available only on our website. If a founding family's subscription ends for any reason, including cancelling, moving to an app store, or a renewal payment still unpaid after the 7-day grace period, the discount ends permanently and cannot be restored, even if the family subscribes again.

How you pay. You buy a plan on our website, and Stripe handles the payment. We never receive your card number. When subscriptions are available in the App Store, you may subscribe there instead; Apple handles the payment under its own terms, at the same regular headline prices as our website. Google handles purchases under its own terms if Google Play purchases become available. A family pays through only one of these at a time. Founding pricing is available only through our website, as described above.

Automatic renewal. Your plan renews automatically at the end of each billing period, monthly or yearly, and charges the card on file until you cancel.

Renewal reminders and price changes. For a yearly plan, we email you 30 days before each renewal with the date and amount. If we change the price of your plan, we email you at least 30 days before the new price applies, and you can cancel before it does.

How to cancel. You can cancel at any time in the parent portal. If you subscribe through an app store, you cancel in that store's subscription settings.

What happens when you cancel. Your plan stays active until the end of the billing period you already paid for. It then stops renewing.

When your plan ends. After your trial or plan ends without payment, you can still sign in and view your family's information, but your children cannot send notes and cannot use groups or games until a paid plan starts again. We do not close your account or delete your family's information because a plan ended, and you can start a plan again at any time. If you want your information deleted, close your account (section 15).

If a payment fails. If your renewal payment does not go through, we will try your card again and email you. You keep paid access for 7 calendar days while we retry. If payment still has not gone through by then, your plan ends as described above; nothing is deleted because a payment failed. A founding discount is lost permanently in that case.

No refunds. We do not refund unused time on monthly or yearly plans, except where the law requires it or to correct a billing error. If you cancel, you keep access through the end of the period you paid for. If you subscribe through an app store, refunds are handled by Apple or Google under their rules.

7. How notes are checked

A child's notes and pictures are checked before they are delivered. Simple built-in rules can clear some plain text notes. Every other note, and every picture, is checked by our AI safety check. Game moves, stickers and reactions are fixed choices with no words or pictures, so they are not checked. In grown-up chat, words are not checked, but pictures and doodles are checked for child sexual abuse material.

A check can deliver a note, hold it for a parent to look at, or block it. If a check cannot finish, the note is held, not delivered.

No automated system detects all harmful content. Checks can miss things, and they can hold or block notes that were fine. They help, but they do not replace a grown-up's supervision.

Our Privacy Policy, section 5, explains what is sent for the safety check, what is not, and how long it is kept. When you give parental consent at sign-up, you agree to this check. In the app we also ask you for a separate permission for the AI safety check. If you choose "Not now", until you allow it, your child can still use stickers and games as part of your plan. Notes and pictures your child tries to send are not sent and not stored: they are not delivered and not sent for the safety check until you turn the check on. You can change this anytime in Settings → Privacy.

8. Rules for kids: notes, friend codes and games

Please go over these rules with your child. Your child should:

Every contact needs a parent's approval first. Parents approve friends, only a parent can create a group, and a child cannot invite anyone to one. PassTheNoteKids has no social media features. Our Privacy Policy, section 6A, explains groups, friend codes and games.

9. Rules for grown-up chat

Grown-ups can write to the other grown-ups in their household, to the grown-ups in a family whose child is their child's approved friend, and one-to-one with a single grown-up contact. A family-to-family chat includes every grown-up in both families, including co-parents.

Be respectful. Do not send harassment, threats, illegal content, or sexual content involving a minor. The words you send other grown-ups are not checked before delivery, but pictures and doodles are checked for child sexual abuse material. Grown-ups can also play games with any of their contacts. Either person can report a note or close the conversation at any time.

10. Co-parents

A co-parent you invite has their own account and gives their own consent. A co-parent can see and approve only what you give them permission to. If you give a co-parent permission to view conversations, they can see your children's conversations as described in our Privacy Policy, section 6, including notes from before they joined and the family conversation between you and your child. When a note sent one-to-one between two children is held, only a parent or co-parent of the child it was sent to, with permission to approve notes, decides whether it is delivered; the sending child's parents are told that a note was held. When a note sent in a group is held, a parent or co-parent of the child who sent it, with permission to approve notes, decides for the whole group whether it is delivered.

11. Reporting and blocking

A child can tap "this doesn't feel right" on any note. A grown-up can report a note from the parent portal or the app. When you send a report, we automatically confirm we got it. When a child sends a report, they see a short, neutral message that a grown-up on our safety team will review it, and our safety team decides after review whether to tell the child's parent. We aim to review ordinary reports within 2 business days, and urgent safety reports go first; this is a target, not a guaranteed deadline. You can also block another child at any time. A block applies everywhere, including to friend codes. To ask us to remove an intimate image shared without consent, email [email protected] with the subject "Removal request". We remove a validly reported image within 48 hours (Privacy Policy, section 14).

If you or your child see something that puts someone in danger, contact local emergency services first.

12. If someone breaks these rules

If an account breaks these Terms, we may hold or remove content, limit features, or suspend or close the account. Where the law requires it, we report content to the National Center for Missing & Exploited Children and to law enforcement, as our Privacy Policy, section 14, explains.

13. Using our website and our content

Using the website. Do not misuse our website or the app. That means no attempts to break, overload, scrape in bulk, probe, or gain unauthorized access; no submitting other people's information without permission; and no unlawful use.

Our name and content. The "PassTheNoteKids" name, logo, copy, and design are owned by PassTheNoteKids LLC and are protected by applicable laws. We grant you no license to use them. Do not copy, reproduce, or use our branding without written permission.

Links to other sites. Our website links to our pages on other platforms, such as Facebook and Instagram. We are not responsible for the content or practices of those sites.

14. Your content

You and your children keep ownership of the notes, pictures and doodles you send. You give us permission to store them, check them as described in section 7, deliver them to the people they are meant for, and show them to the parents who can see them, as our Privacy Policy describes. We do not sell your content and do not use it for advertising. We do not use your family's notes or pictures to train AI models. We do not currently use past safety check results to improve our built-in rules; if we ever do, our Privacy Policy, section 5, explains what we will do first.

15. Closing your account and deletion

You can close your account at any time in the parent portal (Settings) or the iOS app. A plan ending does not close your account (section 6).

Closing your account does not erase everything right away. It starts a 30-day window, during which our support team can restore it if the deletion was a mistake. After that window, a person on our team runs a deletion tool that permanently erases a closed account's information, with these exceptions:

Our Privacy Policy, section 9, explains exactly what deletion removes today and its limits.

16. Our iPhone app

When our iPhone app is available in Apple's App Store, these Terms apply to your use of it. When subscriptions are available in the App Store, you can subscribe there under Apple's terms, or on our website through Stripe. A family pays through only one billing provider at a time. If purchases are not available in your app version, you can manage your plan on our website. If we later offer purchases in Google Play, Google's terms also apply to them. An Android app will follow; we have not announced a date for it.

If you got the app from Apple's App Store: these Terms are between you and PassTheNoteKids LLC, not Apple. We, not Apple, are responsible for the app and its content, for maintaining and supporting it, and for any claims about it, including product-liability, consumer-protection, privacy and intellectual-property claims. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the app's purchase price (if any); Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you are not in a country subject to a U.S. government embargo and are not on a U.S. government restricted-party list.

17. Disclaimers and limitation of liability

Disclaimers. PassTheNoteKids is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do our best to keep PassTheNoteKids running and safe, but we do not promise it will always be available or free of errors. No automated system detects all harmful content.

Limitation of liability. To the fullest extent permitted by law, we will not be liable for any indirect, incidental, or consequential damages arising from your use of PassTheNoteKids.

18. Disputes and governing law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles.

If you have a problem, please write to us first at [email protected] so we can try to fix it.

Any dispute arising out of or relating to these Terms or PassTheNoteKids will be brought only in the state or federal courts located in Orange County, Florida, and you and we consent to the jurisdiction of those courts.

19. Changes to these Terms

We may update these Terms as PassTheNoteKids changes. We will post the new version with a new effective date and a short summary of what changed. If we make a material change, we will tell you at least 30 days before it takes effect, by email, and where the law requires it, we will ask you to agree again.
